We reserve the right to decline a service request at our discretion, including where the job presents safety risks that cannot be safely managed with available equipment, where access to the vehicle is restricted, or where prior payment obligations have not been met.
Estimates provided before a job begins are based on the information available at the time of the request. Final charges may differ if the actual conditions at the scene differ from what was described - for example, if the vehicle is heavier than reported, if the recovery is more complex, or if additional equipment or labor is required.
We will communicate any changes to the estimate before proceeding with additional work where practicable. You are responsible for all charges incurred in connection with the service provided.
Towing and storage rates may be subject to applicable California state or local rate regulations. We will provide an itemized invoice upon request.
Scheduled appointments may be cancelled or rescheduled by contacting us as early as possible. Cancellations made after a truck has been dispatched may result in a trip charge to cover the cost of dispatch and travel to the service location.
For emergency towing calls, response times are estimates only and are subject to traffic, weather, road conditions, and equipment availability. We are not liable for delays caused by circumstances outside our reasonable control.
Payment is due at the time of service unless a prior account or invoicing arrangement has been established in writing. Accepted payment methods will be communicated at the time of service. Fleet accounts are subject to separate credit terms agreed upon in writing.
Invoices not paid within the agreed period may be subject to late fees and collection costs, including reasonable attorney fees, to the extent permitted by applicable law.
You are responsible for accurately describing the vehicle, its condition, its load, and the circumstances of the breakdown or incident when requesting service. Inaccurate descriptions may result in the wrong equipment being dispatched, additional charges, or our inability to complete the job safely.
We take reasonable care when handling your vehicle, but we are not responsible for pre-existing damage, damage caused by the mechanical failure that necessitated the tow, or damage that results from conditions that were not disclosed at the time of dispatch.
Any claim for damage to a vehicle must be reported to us before the vehicle leaves our custody. Claims made after the vehicle has been released will be evaluated on a case-by-case basis.
To the maximum extent permitted by applicable law, Oakley Heavy Duty Towing Service shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our services or your use of our website, including lost profits, lost revenue, or business interruption, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from a specific service event shall not exceed the amount paid for that service.
Our services are provided "as is" and without warranty of any kind beyond those implied by applicable California law for service contracts. We do not warrant that our website will be available at all times, error-free, or free from viruses or other harmful components.
Vehicles stored at our facility or at a designated storage location accrue daily storage fees beginning on the date of arrival. Storage fees are the responsibility of the vehicle owner. You will be notified of your vehicle's location and contact information for the storage facility if applicable.
Vehicles not claimed within the period allowed by California law may be subject to lien sale proceedings in accordance with applicable state statutes.
We encourage you to contact us directly to resolve any dispute. If a dispute cannot be resolved informally, both parties agree to first attempt mediation before pursuing any formal legal proceedings.
Any unresolved dispute shall be submitted to binding arbitration in accordance with the rules of a mutually agreed arbitration provider, unless the claim falls within the jurisdiction of a California small claims court. The arbitration shall be conducted in Contra Costa County, California.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Contra Costa County, California.
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You may not attempt to gain unauthorized access to any part of the website, disrupt its operation, or use it to transmit harmful or unlawful content.
